BENEATH THE BARK KENNEL'S ENTIRE EXPRESSED GUARANTEE
Beneath the Bark Kennel, (hereafter known as seller), and the buyer named below acknowledges agreement in writing to all conditions stated below by signing this guarantee. This guarantee covers this dog against fatal viruses, (these include Distemper, Parvo and Corona) for three days from date of possession by buyer. It also covers this dog against life-threatening congenital disease only for one-year from date of purchase. No guarantee is given regarding the size and/or color of this dog at maturity or of buyer's ability to show or breed this dog regardless of the dog's show or breeding potential. No other guarantees are given, either expressed or implied. This guarantee is between the seller and initial buyer only and becomes null and void if ownership changes.
TO VALIDATE THIS GUARANTEE THE BUYER MUST MEET THE FOLLOWING TERMS:
Buyer must take this dog to a licensed Veterinarian within three business days of possession. Buyer must inform seller by email of the Veterinary examination results within twenty-four hours of the exam. The failure of the buyer to do this will result in the automatic cancellation of this guarantee and void all of the seller's liability regarding this dog.
Terms for the fulfillment of guarantee on covered health issues:
(1) If one of the aforementioned fatal viruses is diagnosed by a Veterinarian within three days from the date of possession by buyer, the buyer must notify seller by email within twenty-four hours of this diagnosis. A written affidavit from buyer's Veterinarian verifying and describing the clinical tests performed and results confirming the diagnosis of the fatal virus and verification of the dog's microchip number must be mailed to seller within one week of this diagnosis. If this fatal virus resulted in death within three days from date of possession by buyer this dog's microchip must also be returned to seller (as proof of death) accompanying the Veterinarian's affidavit within one week of death.
(2) If any life-threatening congenital disease is diagnosed by a Veterinarian within one-year of the date of purchase, buyer must notify seller by email within twenty-four hours of this diagnosis. A written affidavit from buyer's Veterinarian verifying and describing the congenital disease including the clinical tests performed and results confirming the diagnosis of said life-threatening congenital disease and verification of the dog's microchip number must be mailed to seller within one week of this diagnosis.
The failure of the buyer and buyer's Veterinarian to perform the requirements in (1) or (2) will result in the automatic cancellation of this guarantee and void all of the seller's liability regarding this dog.
Buyer further agrees to maintain this dog's veterinary health, including, but not limited to, keeping it current on all vaccinations and wormings, etc., as recommended by a licensed Veterinarian and that failure to do so will automatically void this guarantee. Buyer agrees to indemnify and hold seller harmless for any and all associated charges incurred by buyer on this dog, including, but not limited to, any veterinary charges, shipping charges, attorneys' fees, etc. This guarantee is limited to the replacement of this dog with a puppy of equal value only, as soon as the seller has one available. Buyer agrees that transportation costs of any replacement puppy will be at the buyer's expense. Buyer agrees that he/she understands this guarantee fully, and that any and all disputes concerning this transaction shall be solely under the jurisdiction of the State of Missouri, in the County of Douglas. This guarantee is valid only after being signed and dated by both the buyer and the seller.
